Gomoku Narabe is a board game app published by Kieran Wood ("we", "us"). These terms are the agreement between you and us for using the app. By installing or playing it you accept them. If you do not accept them, do not use the app. Questions: support@gomokuapp.com.

How the app handles your data is covered separately by the privacy policy, which forms part of these terms.

Who may use it

You must be at least 13 years old to use Gomoku Narabe, or older if the law where you live sets a higher age for agreeing to terms like these or for consenting to the processing of your data. The app is a general-audience game and is not directed at children under 13.

Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Gomoku Narabe on devices you own or control, for your own non-commercial enjoyment. We keep ownership of the app, its code, artwork, sounds and name — nothing here transfers any of it to you.

You may not copy, sell, rent or redistribute the app; reverse-engineer, decompile or modify it, except where local law says you may despite this clause; or use a modified client, automated player, bot or engine assistance to play against other people.

If you obtained the app from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies to it, and prevails over these terms to the extent of any conflict. If you obtained it from Google Play, Google's Play Terms of Service apply to your download in the same way. Apple and Google are not parties to these terms and are not responsible for the app, but each may enforce these terms against you as a third-party beneficiary.

Your account

Online play needs an account, which the app creates for you. You may link it to Game Center or Google Play Games so it survives a reinstall. You are responsible for what happens on your account and for keeping access to the platform account it is linked to — we cannot recover an unlinked account that has been lost.

Display names are unique and are yours to hold, not to own. We may change or reclaim a name that impersonates someone, infringes a trade mark, or breaks the content rules below.

Content and conduct: no tolerance for abuse

There is no tolerance for objectionable content or abusive behaviour in Gomoku Narabe. Accounts that post it are suspended or removed.

Some parts of the app let you create things other players see: your display name, your avatar, and chat messages in games. When you do, you agree not to submit anything that:

You keep ownership of what you create. You give us permission to store it and show it to the players it is meant for — your name, avatar, country and rank to other players and on leaderboards, and your messages to the player you are talking to — for as long as your account exists.

Reporting, blocking and moderation

Every player can report another player from the game screen, the end-of-game card, the rating history or a player's profile, and can block a player so the two of you are never matched again. Display names and chat are automatically filtered for offensive language.

We review every report and act on it within 24 hours, removing offending content and ejecting the player who posted it. Depending on what we find, we may warn you, change or remove your display name or avatar, suspend your account from matchmaking for a period or permanently, void ranked results, or delete your account outright. Where a report concerns behaviour in matchmaking, our review may include reading the messages you sent in your recent matchmade games. Chat with players on your friends list is private and is not reviewed.

We do not tell the player who was reported who reported them.

Ranked play and fair play

The ranked ladder only means anything if results are earned. You agree not to use an engine, bot or outside assistance in a ranked game; not to arrange results with an opponent, or play from more than one account to move a rating; and not to interfere with the app's clocks, rules or reporting of results.

Where we conclude that a ranked game was not played fairly, we may reverse the rating it paid out. Because a game has two sides, reversing it adjusts both players — the rating taken unfairly is given back, and the player who lost it is made whole. Both players are told that a game was removed from their record. A rating is a score in a game, not property, and has no cash value.

Purchases

Gomoku Narabe is free to play. It offers one optional purchase — Gomoku Pro — which removes ads and unlocks the post-game review, the avatar builder and the board themes.

Advertising

Unless you buy Gomoku Pro, the app shows occasional full-screen ads, supplied by Google AdMob. What that involves for your data — including the consent form shown in the EEA and UK, and the tracking permission asked on iOS — is described in the privacy policy.

The app may change

We may update, change or remove features, rulesets, board themes or online services, and may stop offering the app altogether. We will give reasonable notice in the app before withdrawing online play, where we can. Local play against the computer and pass-and-play do not depend on our servers and keep working without them.

Ending your account

You can delete your account at any time from the app's menu, or by emailing us — see deleting your account for what that removes and what is kept. We may suspend or end your access if you break these terms, and will tell you why unless we are prevented from doing so.

Liability

The app is provided as it is. Beyond what we promise in these terms, and to the extent the law allows, we do not guarantee that the app will be uninterrupted, error-free, or available at any particular time, and we are not liable for lost game progress, lost ratings, or losses we could not reasonably have foreseen. Nothing here limits our liability for death or personal injury caused by negligence, or for fraud.

Australian consumers: our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. Nothing in these terms excludes, restricts or modifies those rights. Where the law allows us to limit our liability for a failure that is not major, our liability is limited to resupplying the service or paying the cost of having it resupplied.

If you are a consumer elsewhere, you keep whatever mandatory rights the law where you live gives you, and nothing here takes them away.

Changes to these terms

If these terms change, the date at the top changes with them, and material changes are announced in the app. Continuing to play after a change means you accept the revised terms. If you do not, stop using the app and delete your account.

Governing law

These terms are governed by the laws of Australia, and the courts of Australia have non-exclusive jurisdiction over any dispute. If you are a consumer, you may also bring proceedings in the courts of the country where you live, and the mandatory consumer law of that country still applies to you.
